Terms of sale

These terms govern the sale of user licences for the Bulleur PARFAIT software (the “Software”), published by MAISON PARFAIT ([FULL NAME], sole trader) (the “Seller”), to any business or consumer customer (the “Customer”).

Placing an order implies full acceptance of these terms.

The Software is offered as a monthly subscription, an annual subscription or a lifetime licence. Each licence covers a number of seats (computers) chosen at checkout, from 1 to 25.

The lifetime licence grants unlimited use of major version 1 (versions 1.x) and one year of updates from purchase. Later major versions (2.0 and above) are offered separately.

Subscriptions include every update released during the paid period.

Prices are in euros. VAT not applicable, article 293 B of the French General Tax Code.

Per-seat prices are progressive: each seat is charged at the rate of its rank (1st seat, 2nd–4th, 5th–10th, 11th–25th). The total is shown before the order is confirmed, and that total is what is charged.

Above 25 seats, a quote is provided on request.

Payment is made by card through the secure Stripe platform. The Seller never has access to card data.

Subscriptions renew automatically at each term (month or year) until cancelled.

An invoice is made available after each payment.

The licence key is sent by e-mail to the address given at checkout, normally within minutes. The Software can be downloaded from the website.

Customers can retrieve their key at any time from the “Manage my licence” page.

Under article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a tangible medium whose performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal.

By ticking the dedicated box before payment, the Customer requests immediate performance of the contract — delivery of the licence key — and expressly waives the right of withdrawal. The date and time of this consent are stored with the order.

Business customers have no right of withdrawal, except as provided by article L221-3 of the French Consumer Code.

The Seller grants the Customer a non-exclusive, non-transferable right to use the Software on the number of seats purchased. The Software is licensed, not sold.

The Customer can release a seat from within the Software to activate it on another computer.

Reselling or sharing the key beyond the purchased seats, decompiling (except where permitted by law) and circumventing the licence system are prohibited.

In case of breach, the Seller may revoke the licence after a formal notice left unremedied for 15 days.

Subscriptions can be cancelled at any time from the Stripe customer portal, available on the “Manage my licence” page. Cancellation takes effect at the end of the current period; no pro-rata refund is made.

At expiry the licence stops working. Files already produced (PDF, Excel) remain the Customer's property and are not affected.

The Software is a tool that helps prepare inspection documents. It does not replace the judgement of a qualified person. The Customer remains solely responsible for checking the dimensions, tolerances and values read, calculated or reported by the Software, and for the conformity of the parts produced, inspected or delivered.

The Seller has an obligation of means. It shall not be liable for indirect damage such as lost production, scrap, rework, late delivery, part recalls, or loss of revenue or customers.

For business customers, the Seller's total liability, for all causes combined, is limited to the amounts actually paid by the Customer in the twelve (12) months preceding the event giving rise to the claim.

These limitations do not apply in case of gross negligence or wilful misconduct, to personal injury, or to rights consumers hold under mandatory law.

Drawings and documents processed by the Software stay on the Customer's computers and are never sent to the Seller. Personal data related to orders is described in the privacy policy.

These terms are governed by French law.

Consumers may use the consumer mediator free of charge: [MEDIATOR NAME AND CONTACT], or the European online dispute resolution platform.

Between businesses, the courts of [CITY] have exclusive jurisdiction.
